Terms of Use
These terms apply to the game Piki & Max (the “App”) made by Black Yellow Studio (“we”, “us”). By downloading or playing the App you agree to them. The App is also licensed to you under Apple's Licensed Application End User License Agreement (the “Apple EULA”); these terms add to it, and if the two differ, the Apple EULA applies.
1. License
We give you a personal, non-exclusive, non-transferable license to download and play the App on Apple devices you own or control, as allowed by the App Store rules, for non-commercial entertainment.
2. Ownership
The App and everything in it, including the characters Piki and Max, the story, artwork, music, sounds, text and code, belong to Black Yellow Studio or its licensors and are protected by copyright and other laws. Third-party music and assets are used under their own licenses, listed in the App's credits. These terms do not give you any rights to our names, characters or trademarks.
3. What you may not do
- Copy, sell, rent, redistribute or publicly share the App or its content, except as the App Store allows.
- Reverse-engineer, decompile or modify the App, except where the law allows it despite this restriction.
- Use the App for anything unlawful, or try to interfere with other players' devices in nearby co-op.
4. Nearby co-op
Nearby co-op connects directly to devices close to you. Only play with people you know. Parents and guardians should supervise young children when they connect with other devices.
5. Price, purchases and changes
Level 1 is free. Levels 2–5 are unlocked with a one-time in-app purchase; its price is shown in the App Store in your currency before you buy. Purchases are processed by Apple under the Apple Media Services Terms, and refunds are handled by Apple (reportaproblem.apple.com). You can restore the purchase on your other devices with the same Apple Account using “Restore Purchases”. The App has no ads. We may update, change or stop offering the App or any part of it, but we won't take away content you have bought.
6. Privacy
The App does not collect personal information. Game Center and iCloud are Apple services. See our Privacy Policy.
7. No warranty
The App is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that the App will be error-free or work on every device. Some places do not allow these exclusions, so they may not apply to you.
8. Limitation of liability
To the extent the law allows, Black Yellow Studio is not liable for indirect, incidental or consequential damages, or for loss of data (such as game progress), arising from your use of the App. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.
9. Apple
These terms are between you and Black Yellow Studio, not Apple. Apple is not responsible for the App or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them.
10. Changes to these terms
We may update these terms. The date above shows the latest version. If you keep playing after an update, you accept the new terms.
